PayTile Legal Notices

Please read this information carefully and print or retain an electronic copy of it for future reference.

Introduction. This Electronic Communications Consent ("Consent") applies to all electronic communications relating to the PayTile App available in the Apple App Store and on Google Play Store (the "App"), your transactions on the App, and services made available to you via the App. In the future, we may decide to make services available through the PayTile Website located at paytile.com (the "Website"), in which case, then all references to "App" in this Consent include the Website.

In this Consent, "we", "us", or "our", refers to PayTile LLC and Cross River Bank, Member FDIC. "I", "you", and "your" mean the user of the App. "Communication” or “Communications” means any message or correspondence that we may provide to you electronically relating to the App, your transactions on the App, or the services made available to you via the App. "Documents" means any writings, disclosures, account agreements, or notices, policies, applications, and other communications relating to the App, your transactions on the App, or the services made available to you via the App.

In order to use the App, you must consent to the use of electronic signatures and electronic records for all Communications and Documents, including those that are required by law.

Delivery of Documents. Once you have given your consent, we may deliver or make any of the Documents available to you by posting them on the App, or sending them to the e-mail address or phone number that we have for you in our records, or via in-app notifications. We reserve the right, in our sole discretion, to communicate with you in paper form. In addition, we reserve the right, in our sole discretion, to discontinue the provision of electronic Communications or to terminate or change the terms and conditions on which we provide electronic Communications.

Effect of Electronic Signature. Your electronic signature on agreements and documents has the same effect as if you physically signed the document with a pen. You will not contest the legal effectiveness, validity, enforceability or use of the electronically stored copies of any agreements electronically signed by you based on the fact that the terms were accepted electronically. The term “electronic signature” means an electronic sound, symbol, or process, attached to or logically associated with a contract or other record and executed or adopted by a person with the intent to sign the record, which includes, without limitation, your initial sign up to the PayTile App that constitutes your signature and consent to the Terms of Service and this Consent.

Your Legal Rights. Certain laws require us to provide specific information to you in writing, which means you have a right to receive that information on paper. We may provide such information to you electronically once you have provided us consent to such electronic format in the form of agreeing to this Consent.

Scope of Your Consent. Your consent to the use of electronic signatures and electronic records applies to all Communications and Documents.

Hardware and Software Requirements. You agree that you have the hardware, software, and other technology described below that is necessary for you to receive, review, obtain, and retain Communications and Documents. To access and retain electronic records of the Documents, you must have: (1) email address and/or phone number; (2) a smart phone; (3) a connection to the Internet; (4) a computer with the current version of Internet Explorer 8 (or higher), Mozilla Firefox 7.0, Safari 5, or Chrome 15; (5) a Current Version of a program that accurately reads and displays PDF files such as Adobe Acrobat Reader version 7 or higher; and (6) a computer or device and an operating system capable of supporting all of the above. “Current Version” means a version of the software that we support and that is currently being supported by its publisher. You also may access and retain electronic records of the Documents on the App.

Withdrawing Your Consent. Your consent to receive Communications electronically will remain in effect until you withdraw it. You may withdraw your consent to receive further Communications electronically at any time by sending your withdrawal request to us at [10290 Alliance Road, Cincinnati, OH 45242]. If you withdraw your consent to receive Communications electronically, we reserve the right to terminate your access to the App. Any withdrawal of your consent to receive Communications electronically will be effective only after we have a reasonable period of time to process your withdrawal. Please note that your withdrawal of consent to receive Communications electronically will not apply to Communications electronically provided by us to you before the withdrawal of your consent becomes effective. You will not be charged a fee for withdrawal of your consent.

Obtaining Copies of Documents. You should print and save or electronically store a copy of all Communications and Documents that we send to you electronically. You may obtain a paper copy of any Document by contacting us at [10290 Alliance Road, Cincinnati, OH 45242] and requesting a paper copy for as long as we are required to retain such information in accordance with our document retention policies and applicable law. There is no charge for paper copies.

Your Contact Information. In order to ensure that we are able to provide Communications to you electronically, you must notify us of any change in your email address and your mobile device number or other text message address by updating your profile on the App or contacting us at support@paytile.com. If you fail to update or change an incorrect e-mail address, you understand and agree that any Communication or Document shall nevertheless be deemed to have been provided to you if it was made available to you in electronic form on the App or e-mailed to the e-mail address we have for you in our records.
